The EB-5 Immigrant Investor Visa attracts foreign capital in the U.S., creates jobs for U.S. workers, and most importantly, provides for a route to a Green Card and eventually citizenship for the Investor.
The EB-5 Visa requires you, as the Investor, to show that the investment directly or indirectly results in the creation or preservation of 10 full-time jobs in the U.S.
The EB-5 Visa requires capital, which means cash, equipment, inventory, tangible property, case equivalents, and indebtedness secured by assets owned by you. You must show that these funds come from a legitimate source. The investment must be at-risk, which means you have put up capital that could be lost.
In general, the minimum qualifying investment in the U.S. is $1 million for city areas. For a targeted employment area (high unemployment or rural area), the minimum qualifying investment in the U.S. is $500,000. A targeted employment area is an area that is a rural area or an area which has experienced unemployment of at least 150% of the U.S. national average rate. A rural area is any area not within either a metropolitan area (as designated by the Office of Management and Budget) or the outer boundary of any city having a population of 20,000 or more (according to the most recent U.S. Census data).
Finding a Project
The EB-5 Investor must find a project to invest in, either a business, investment project, or a "Regional Center." A Regional Center is a U.S. government set-up pilot entity which promote growth in certain geographic areas. In this situation, you would invest your money into the Regional Center, but would see a very small return on capital.
Filing the Petition
Ma'ayergi & Associates will assist you in filing the petition, which generally takes up to six months to get a decision from the Government.
After the initial petition, the Government may request additional evidence. Do not worry as this is a normal process for the Government to further examine your investment. It also gives you the opportunity to strengthen your case for your EB-5 petition.

Once the petition is filed and approved, the Government will issue you a conditional Green Card while you move forward wtih hiring the required 10 full-time U.S. workers.
